Kajawis Online Store Terms & Conditions

These Terms & Conditions define, among other things, the rules for concluding contracts via the Kajawis online store, and include key information about the Seller, the Store, and Consumer rights.

§ 1 Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

  • Consumer - a natural person who enters into a contract with the Seller not directly related to their business or professional activity.
  • Privileged Buyer - a Consumer or a natural person concluding a contract directly related to their business activity, but not of a professional nature.
  • Seller - Kajawis sp. z o.o., registered at ul. Graniczna 16, 25-649 Kielce, Poland, NIP: 6572959223, REGON: 524242332.
  • Store - the Kajawis online store operated by the Seller at https://kajawis.pl.
  • Customer - any entity making a purchase through the Store.
  • Terms & Conditions - this document that defines the rules of using the Store and concluding sales contracts with the Seller.
  • Order - a declaration of will submitted by the Customer through the Store to conclude a sales contract with the Seller.

§ 3 Technical Requirements

To use the Store, including browsing the assortment and placing orders, you need:

  • an end device with internet access and a web browser;
  • an active email account (e-mail);
  • enabled cookies and JavaScript support in the browser.

§ 4 Shopping in the Store

1. To place an order in the Store, you must add the selected product to the cart, then choose the method of delivery and payment, and provide the necessary information to complete the order.

2. Orders can be placed in the Store 24 hours a day, 7 days a week.

3. The conclusion of the sales agreement between the Customer and the Seller occurs after the Customer places an order and receives confirmation of order acceptance from the Seller at the email address provided during ordering.

4. In the case of Customers who are privileged buyers, the Seller confirms the conclusion of the contract on a durable medium no later than at the time of delivery of the item.

5. Customers can register in the Store or make purchases without registration by providing the necessary data each time.

§ 5 Payments

1. You can pay for your order, depending on your choice:

  • by regular bank transfer to the Seller’s account,
  • via an electronic payment system (e.g. Przelewy24),
  • by card (through the payment operator, if available).

2. Detailed information about available payment methods is displayed at the order placement stage and may also be found in the "Payment Methods" section of the Store.

3. If you choose to pay in advance, the order must be paid for within 3 business days of placing it. Otherwise, the Seller may cancel the order.

4. The Seller starts processing the order after it has been paid (unless cash on delivery is selected, if available).

§ 6 Order Fulfillment

1. Order processing time is shown on the individual product page.

2. If your order includes multiple products with different processing times, the longest one applies to the entire order.

3. In the event of delays, the Seller will notify the Buyer via email or phone.

4. Orders are fulfilled within the territory of Poland. For shipping abroad, individual arrangements with the Seller are required.

§ 7 Delivery

1. Delivery of goods is carried out through courier services or InPost Parcel Lockers.

2. Delivery costs are displayed during the order placement process and depend on the delivery and payment method chosen.

3. Free delivery is available for orders exceeding the amount specified in the Store.

4. Delivery time depends on the selected delivery method and is typically 1–3 business days from dispatch.

§ 8 Payment Methods

1. The following payment methods are available in the Store:

  • Bank transfer to the Seller’s account
  • Online payment via Przelewy24

2. Detailed information about available payment methods can be found during the ordering process and on the Store’s website.

§ 9 Order Fulfillment Time

1. The fulfillment time of the order includes the time needed to prepare the goods for shipment (up to 3 business days) and the delivery time, depending on the selected delivery method.

2. In the case of payment by bank transfer or online payment, the order processing time starts from the moment the payment is credited to the Seller's account.

3. Delivery time depends on the selected shipping method and courier company, and usually takes up to 2 business days within Poland.

§ 10 Right of Withdrawal

1. A privileged buyer (i.e., a consumer or a sole proprietor for whom the contract with the Seller is directly related to their business but not of a professional nature) has the right to withdraw from a distance contract within 14 days without giving any reason.

2. The withdrawal period expires 14 days from the day on which the buyer or a third party other than the carrier and indicated by the buyer acquires physical possession of the goods, or - in the case of multiple goods ordered by the buyer in one order and delivered separately - from the day on which the buyer acquires possession of the last item.

3. To exercise the right of withdrawal, the buyer must inform the Seller of their decision by an unequivocal statement (e.g., by email to info@kajawis.pl).

4. To meet the withdrawal deadline, it is sufficient to send the notice before the 14-day period has expired.

5. In the event of withdrawal, the buyer must return the goods to the Seller’s address: ul. Graniczna 16, 25-649 Kielce, no later than 14 days from the day on which the withdrawal notice was submitted.

6. The Seller will reimburse all received payments no later than 14 days from the day on which the Seller was informed of the decision to withdraw, using the same payment methods as were used in the original transaction, unless expressly agreed otherwise.

7. The Seller may withhold reimbursement until the goods have been returned or until the buyer has supplied evidence of having sent back the goods - whichever occurs first.

8. The right to withdraw does not apply to contracts for:

  • goods made to the consumer’s specifications or clearly personalized,
  • goods which are liable to deteriorate or expire rapidly,
  • sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery,
  • sealed audio/video recordings or computer software which were unsealed after delivery.

§ 11 Complaints

The following information applies to so-called privileged buyers. If you are not one, please refer to our Store Regulations for detailed complaint procedures.

If we fail to fulfill the contract properly, you have the right to submit a complaint - preferably by email to info@kajawis.pl or by post to: ul. Graniczna 16, 25-649 Kielce.

As a rule, we are liable for non-conformity of the goods with the contract that existed at the time of delivery and becomes apparent within two years.

Under the provisions of the Consumer Rights Act, in such a situation you may request:

  • a replacement of the product,
  • or repair of the product.

In some cases, you may also:

  • withdraw from the contract,
  • or submit a statement requesting a price reduction.
